"Oil and Gas Royalties: A 19th Century System in a 21st Century World"
Fundamental real property laws in the American West were created when paper deeds were drafted by hand and delivered to the courthouse by horseback. Those 19th Century land laws continue to shape land ownership today. In recent years, increasing numbers of recording systems are available at the push of a button from anywhere in the world. Are oil and gas companies prepared for an all-electronic era in real property records? This presentation surveys a variety of 19th Century laws and their legacy impact on mineral ownership and conveyancing today. It also explores the potential vulnerabilities in our current system for distributing royalties as everything from mineral conveyancing to oil and gas well production data comes to reside on the internet.
